Former Kiambu Governor Ferdinand Waititu has suffered a major setback after the High Court dismissed his bid to overturn a 12-year jail term he is currently serving for corruption.

In a ruling delivered on Tuesday, September 16, 2025, Lady Justice Lucy Njuguna rejected an application filed by Waititu on August 28, 2025, in which he sought to review the sentence handed to him earlier this year.

Waititu’s Case

In February 2025, Waititu was convicted on corruption-related charges and ordered to either pay a fine of Ksh53.5 million or serve 12 years in prison.

The court found that he irregularly received Ksh25 million from Testimony Enterprises following the award of a flawed tender, in violation of procurement laws and public trust.

The former governor, popularly known as “Baba Yao”, failed to raise the hefty fine and has since been serving time at Kamiti Maximum Prison.

Court Ruling

Justice Njuguna said the sentence will remain in force until Waititu’s pending appeal is heard and determined.

She directed that the appeal be concluded within 120 days, warning that unnecessary delays by the ex-governor could see the case struck out altogether.

“Justice Njuguna ruled that the sentencing will stand pending the hearing and determination of Waititu’s appeal. She further directed that the appeal be concluded within 120 days, warning that any delays on the part of the former governor could lead to the case being struck out,” the Office of the Director of Public Prosecutions (ODPP) said in a statement shared on social media on Wednesday, September 17, 2025.

Kamiti Stay Continues

Waititu had also sought release on bond but failed to meet the strict terms imposed by the court, which included depositing a Ksh53 million bank guarantee.

As a result, he will continue serving his term at Kamiti Maximum Prison until the appeal is concluded.

The case will be mentioned again on October 1, 2025, when directions on the appeal process are expected to be given.

Police officer suspected of shooting and killing the owner of NaxVegas club, Laura Kwisira and a bar maid, Ann Maina in Nakuru over a Sh16,000 bill will face two counts of murder charges, Office of the Director of Public Prosecutions (ODPP) has said.

Police Constable Nicholas Musau attached to Nakuru Central Police Station on the night of December 12, 2023, shot four people at the club, among them two bouncers.

He was then arrested and presented into court two days later on a miscellaneous application, but had not yet been charged.

The Independent Policing Oversight Authority (IPOA) took over the matter from the Directorate of Criminal Investigations on December 22 last year and realised that there were gaps in the police file.

However, the ODPP has issued a statement confirming that the officer will face two counts of murder.

In a statement posted via social media accounts, the ODPP says IPOA had submitted an inquiry file and having reviewed it, it was satisfied that there is sufficient evidence to sustain a charge of murder.

Office of the Director of Public Prosecutions (ODPP) has issued a statement to set the record straight on the case of slain Meru blogger Daniel Mithiani Bernard, popularly known as Sniper.

The ODPP has broken its silence following a public outcry from the members of the public led by popular bloggers, among them Dennis Itumbi.

So, a SUSPECT in the abduction of SNIPER was arrested, but @ODPP_KE did NOT give DIRECTIONS on how to proceed. @DCI_Kenya told court they were waiting for DPP. Why the delay Mr. DPP? Why is DPP silent internally and publicly? #IamSNIPER pic.twitter.com/w25y6B78yx
— -Dennis Itumbi (@OleItumbi) December 26, 2023

The outcry followed revelations that a suspect identified as Vincent Muriithi Kirimi alias Supuu Wa Mioro had been arrested on suspicion of the abduction of the blogger, then later released.

Kenyans were also angered with revelations that the ODPP had failed to advise the Directorate of Criminal Investigations (DCI) on the next course of action following the arrest of the suspect.

Blogger Siniper’s Murder Suspect Released on Cash Bail

However, the ODPP in a statement released this morning says the DCI, through the ODPP, had filed Criminal Miscellaneous Application No. E116 of 2023, seeking custodial orders pending the completion of investigations, which was declined by the court that released the suspect on a Kshs. 20,000 cash bail.

The suspect was then ordered by the court to report to the police station every 14 days, with the application for a mentioning date set for January 5th, 2024.

Investigations into Sniper’s Murder

The ODPP in the statement further notes that it directed the DCI to conduct investigations into the offense of murder and submit the resulting inquiry file for review and further directions, after the body of the blogger was discovered.

An autopsy done on his body on Friday showed he was strangled on the neck.

Government pathologist Johansen Oduor conducted the examination on Friday at the Marimanti Level 4 Hospital Mortuary.

Oduor said Sniper had marks on his neck and he exhibited signs of a person who had lacked oxygen.

He also had fractured ribs and showed injuries on his head which suggested that he was strangled before being thrown into a river.

DNA Identification

Officials picked up DNA samples to confirm he was the one since his body had already decomposed.

The examination of the body showed there were no defence injuries thus raising questions on whether he was subdued to a level where he could not defend himself.

Family members said the postmortem was done satisfyingly and appealed to security agencies to arrest culprits for justice to be served.

Sniper disappeared on December 2, before his body was discovered on December 16, 2023.
