Kandara Member of Parliament Alice Wahome has spoken on claims of her intended resignation from her legislative role.

The lawmaker has refuted allegations that had been made by Law Society of Kenya President Nelson Havi that she had accepted to resign over Chief Justice David Maraga’s advisory on dissolution of parliament.

“I have seen a post by Nelson Havi LSK President circulating in the social media that I will resign from Kandara Parliamentary seat by reason of C J Maraga advisory of dissolution of Parliament. Advisory is directed against Parliament not individual members. I’m not resigning,” she wrote on Twitter.

Havi through his Twitter handle had said that the vocal Ruto-ally was mulling her resignation from the National Assembly.

“Honorable Alice Wahome Member of National Assembly for Kandara Constituency has confirmed that she will resign following the advise by CJ David Maraga to President Uhuru Kenyatta to dissolve Parliament. Who is else has taken this course we support him/her for re-election?” Havi posted.

CJ Maraga on Monday last week wrote to President Uhuru Kenyatta advising him to dissolve Parliament over its inability to pass the two-thirds gender rule.

The Chief Justice, in his unprecedented move, said Parliament has refused to comply with the High Court order to enact legislation required to implement the two-thirds gender rule for over nine years.

“It is incontestable that Parliament has not complied with the High Court order in Constitutional Petition No. 371 of 2016. As such, for over 9 years now, Parliament has not enacted the legislation required to implement the two-thirds gender rule which, as the Court of Appeal observed in its said judgement, is clear testimony of Parliament’s lackadaisical attitude and conduct this matter,” he said.

Chief Justice David Maraga’s advisory to President Uhuru Kenyatta on dissolution of Parliament has been suspended.

Justice Weldon Korir on Thursday September 24, 2020 suspended the Chief Justice’s advisory on the dissolution of Parliament pending the determination of a case file challenging the letter to the President.

Justice Korir’s ruling came after two petitioners on Wednesday challenged Maraga’s advisory to dissolve Parliament for failing to meet the thirds gender rule.

“In the circumstances of this case, I therefore find the petitioners notice of motion dated September 23 merited. I allow it in terms of prayer so that a conservatory order issued for the preservation of the status quo of the Advice of the Chief Justice dated September 21 to the president pending interparteis hearing and determination of the petition,” Korir ruled on Thursday.

Petitioners Leina Konchella and Abdul Munasar wanted the High Court to stay the advisory, saying it is subject to judicial review as an administrative act.

The petitioners, through lawyer Muturi Mwangi, avered that the written advice to President Uhuru Kenyatta is not judicial.

They further argued that there were no proceedings before the decision was reached.

Leina and Abdul further reasoned that Maraga’s action is beyond his authority to the extent that it purports to be grounded on Parliament’s failure to enact two-thirds gender law.

They say the two-thirds gender rule can only be implemented through extensive amendments to the Constitution.

Exiled lawyer Dr Miguna Miguna has torn into the people threatening Chief Justice David Maraga on his decision on Parliament Dissolution.

Taking to his official social media accounts, Miguna said that the people threatening CJ Maraga do not understand the Constitution or applicable law.

According to his twitter post on Tuesday night, Miguna said that there are valid court orders issued after the two thirds gender rule had been litigated all the way to the Supreme Court.

Miguna went ahead noting that, filing a case to relitigate the issue would be struck out because it would be RES JUDICATA (a matter already settled by judgment), it would be a collateral attack on the valid Orders and the petitioner would be suing the CJ who isn’t a party.

“Filing a case to relitigate the issue would be STRUCK OUT on 3 grounds. First, it would be RES JUDICATA (a matter already settled by judgment). Second, it would be a COLLATERAL ATTACK on the valid Orders. And third, the petitioner would be suing the CJ who isn’t a party ,”tweeted Miguna.

This comes after Maraga advised President Uhuru Kenyatta to dissolve Parliament for failing to implement the two-thirds gender rule.

However, some Senetors said that Article 216(6) requires an order to be issued before the clause(7) is invoked.

Chief Justice David Maraga is on record as the first top judge in Africa to nullify a presidential election in 2017. This was only borrowed recently by Malawi top court which also nullified the presidential poll.

However, Maraga is set to exit office. But who will now replace him?

Well, Attorney-General Kihara Kariuki is emerging the frontrunner in the race to replace Maraga who is set to retire anytime from now.

For now, if Maraga decides to proceed on leave, deputy CJ Philomena Mwilu will act. Mwilu is being favoured by a section in ODM to succeed Maraga by virtue of her closeness to former AG Amos Wako and now Busia senator on ODM ticket.

According to a local daily, Kariuki, formerly the president of the Court of Appeal, is being considered a safe bet by State House mandarins eager to have a reliable gatekeeper at the corridors of justice.

Supreme Court judge Smokin Wanjala is the favourite by the majority of lawyers according to a secret report compiled by various state agencies and if voting by lawyers was to determine the next CJ, Wanjala will definitely win. However, he is seen as independent-minded like Maraga.

Other names that are being touted include East African Community judge Charles Nyachae, former national assembly speaker Kenneth Marende, Supreme Court judge Njoki Ndung’u, Lady Justice Hannah Okwengu of Appeals Court and Solicitor General Ken Ogeto, and Justice Isaac Lenaola mong others.

But according to sources, the State House mandarins do not want a repeat of the 2017 scenario where Maraga led the bench in nullifying the presidential election and that is why they want a reliable candidate for the CJ’s position, and that person is Kariuki.

Besides, the AG is a relative of Uhuru Kenyatta as his mother is the daughter of Senior Chief Koinange. Kariuki, who was born on May 11 1954 in Kiambu, is the son of the late bishop of Anglican Church Obadiah Kariuki and Lillian Wairimu, the daughter of Senior Chief Koinange.

It is to be recalled that Uhuru’s father, Mzee Jomo Kenyatta married his third wife, Grace Wanjiku, daughter of Senior Chief Koinange and sister of Mbiyu Koinange in 1946.

But Wanjiku died when giving birth in 1951 to their daughter, Jane Makena Wambui (also known as Jeni). Jeni Makena Gecaga is the mother of Soiya Gecaga, Nana Gecaga, and Jomo Gecaga, who serves as the president’s private secretary.

Insiders added that State House is keen to have the holder of the CJ’s position a person they can trust since he or she will be instrumental in the re-composition of the Supreme Court bench which will determine any petition challenging a presidential election in 2022.

Already, Justice Jackton Ojwang has retired as Supreme Court judge after attaining the mandatory retirement age while Justice Isaac Lenaola is being fronted to head the Independent Electoral and Boundaries Commission.

Apart from blood ties with the first family, Kariuki is also emerging the favourite due to his past rulings as a judge which have tended to side with the executive.

As the president of the Court of Appeal, he led the bench in overturning a ruling by High Court judge George Odunga that had declared the appointment of returning officers for the 2017 general election as not procedural, a day to the repeat presidential poll.

Justice Odunga had declared the appointments unconstitutional but had declined to grant the reliefs the petitioners were seeking, which included halting the polls.

Nevertheless, Odunga’s ruling, if not overturned, would have come in handy in the petition seeking to declare the repeat presidential poll a nullity.

It was this ruling that saw former Law Society of Kenya chief executive officer Apollo Mboya seek to block Kariuki after Uhuru tapped him to be his chief legal advisor.

Mboya filed a misconduct case at the Judicial Service Commission where he averred that Justice Kariuki was unfit to take over from Githu Muigai as Attorney General.

The JSC formed a special committee to look into the misconduct and insubordination allegations against Kariuki and his fellow Court of Appeal judges, Erastus Githinji, Martha Koome and Fatuma Sichale who had overturned Justice Odunga’s ruling.

The petition questioned how Justice Kariuki was able to impanel a three-judge bench of justices Githinji, Koome and Sichale on a public holiday and without the authorization from the Chief Justice.

He also questioned the manner the appeal was expedited and final ex parte orders given within minutes. But Kariuki passed the vetting and became a member of the JSC by virtue of his position as Attorney General.

Having resigned as a judge, the JSC was not in a position to pursue the matter of his misconduct further. If Kariuki lands the slot, to hoodwink Kenyans that he is not playing tribal card in Judiciary, a face outside Kikuyu will replace him as AG.

There was drama at Milimani Law Courts on Tuesday June 30, 2020 after a woman named Mary Kwamboka Onyancha stormed the Court premises accusing Chief Justice David Maraga of being a deadbeat dad.

The woman claimed that she has unsuccessfully sought help from court since she has no any legal representative. She claimed that CJ Maraga has failed to take his fatherly responsibility after siring a child with her.

She argues that she has been to children offices on several occasions but she has not received any help. She claims that she has been struggling to bring up ‘their child’ alone.

The woman further claims that Maraga has been summoned by Children’s department on several occasions but he has failed to honor the summons.

She says they have been having an affair since 2013.
