Makueni County Senator Mutula Kilonzo Junior has faulted Justice Weldon Korir over his decision to nullify the election of Gatundu North MP Wanjiru Kibe.

Taking to his official twitter account shortly after Justice Korir decalred the Gatundu North Parliamentary seat vacant, Senator Mutula Junior said that such a decision was wrong at this time.

According to the lawmaker, nullification of an election three years after the exercise was a travesty.

He said the lawmakers had amended election laws to ensure that decisions to nullify an elections are made within six months of the election.

“This is a travesty. We amended the Election laws to ENSURE decisions of this nature are made within six months of the elections,” the Makueni senator tweeted.

Justice Korir on Wednesday October 7, 2020 found that the current Member of Parliament Anne Wanjiku Kibe was not eligible to vie for the seat as she was still a member of the County Assembly (MCA) when she was nominated to vie as an MP under the Jubilee ticket.

Article 99 (2)(d) of the Constitution disqualifies a person from being elected as MP if s/he is an MCA.

In a petition filed by former MP Clement Kung’u Waibara, the court agreed with Waibara’s lawyer Jackson Awele that she ought to have resigned before the nomination date.

In June, the Court of Appeal ordered a fresh hearing of a petition challenging her qualifications to contest for the seat in 2017.

This is after the High Court dismissed the petition for lack of merit, which saw Waibara move to the Court of Appeal on grounds that Kibe’s qualification was not determined in two decisions delivered on the merit of the petition and an election appeal.

Makueni governor Kivutha Kibwana has responded to senator Mutula Kilonzo Junior’s threat against him over governor Wycliffe Oparanya’s order to shut down counties over lack of funds.

Mutula Junior on Wednesday September 16, 2020 while responding to Council of Governors chairman’s memo to all governor to shut down some of the county services, threatened to impeach governor Kibwana should he follow Oparanya’s directive.

“I want to tell my governor Kivutha Kibwana, if you close level 4 hospitals in Makueni, we will impeach you. It is an impeachable offence for any governor to take instructions from another governor and shutdown hospitals,” Kilonzo stated.

One after the other, the senators stood and expressed their displeasure with the COG, terming Oparanya as incompetent.

Bungoma Senator Moses Wetangula indicated that it was a clear abuse of power saying that the council of governors was not the employer of any county governors.

Responding to the senators, however, Kibwana indicated that the senators were solely to blame for the stalemate.

“For three months @Senate_KE has denied Counties funds for development and salaries. Can @SenMutula run a county as Governor without funds for three months? My 2014 impeachment by Mutula and others is still in Senate. The Senator’s askari who shot at me was jailed.

“How can Senate miserably fail Kenyans and then blame the presidency and @KenyaGovernors? Several county employees have come to me after their rental premises were padlocked. Senators continue to draw their salaries and sitting allowances. How are they defending devolution?

Governor Kibwana went ahead to dare the Makueni senator to bring on the impeachment motion against him, saying that it will not be the first time he will be doing so.

He argued that he had came across such threats before, and even got a threat that he would be expelled from the Kalonzo Musyoka led Wiper Movement party.

“If Mutula Kilonzo Junior wants to impeach me a second time, he is welcome. I had heard of the impeachment threat and expulsion from @WiperMovement before today,” he posted.

Makueni senator Mutula Kilonzo Junior on Wednesday September 16, 2020 launched a scathing attack against the Council of Governors (CoG) chairman Wycliffe Oparanya.

His attack came shortly after the Kakamega governor issued a memo directing all governors to provide notice on the suspension of some counties’ services due to lack of resources, with effect from tomorrow (Thursday September 17).

Counties were advised to issue necessary notices that the county health facilities will not permit any new inpatient admissions.

They will only provide minimal outpatient services and that all non-essential services suspended and county employees are advised to proceed on leave for two weeks.

In response, senator Mutula Kilonzo Junior claimed that if Governors accede to the memo by Governor Oparanya, they will have violated the Constitution.

While terming Governor Oparanya as clearly incompetent, the lawmaker argued that the Supreme Court issued an unequivocal order on release of funds pending determination of any issue concerning division of Revenue.

However, Senator Mutula’s statement landed him in big trouble with Kenyans on Twitter, with his attack against Oparanya backfiring badly.

Instead, the netizens turned against him, claiming that he was the most incompetent.

They argued that the senate had failed the devolved units by failing to pass the revenue allocation formula for a record 10 times.

Makueni senator Mutula Kilonzo junior has called for the impeachment of senate speaker Keneth Lusaka.

Taking to his official twitter account on Thursday July 23, 2020, the senate minority whip said that senators should impeach Lusaka for adjourning the senate unlawfully.

“We should impeach speaker Lusaka for adjourning the senate unlawfully ! Bure,” he posted.

 A week ago, the Senate was compelled to adjourn a Special Sitting convened for the second time to vote for the formula that has divided the House down the middle.

It followed spirited resistance by senators whose counties were set to lose cash under the proposed arrangement.

A day-long informal gathering (Kamukunji) convened by Speaker Ken Lusaka to build consensus on proposals by the Committee on Finance and Budget ended in disarray after lawmakers whose counties were set to lose up to Sh17 billion stood their ground and vowed to reject the proposal in the House.

They got the support of at least five other senators, mainly from areas controlled by the Orange Democratic Movement (ODM) as well as the Wiper Party, who argued that the formula was “about to split the country into two”.

While supporting the adjournment, Bungoma Senator Moses Wetang’ula said the proposed formula has been divisive from the onset.

Elgeyo Marakwet senator Kipchumba Murkomen has told off Makueni senator Mutula Kilonzo junior after he should interests of defending impeached governor Anne Waiguru.

Senator Mutula Junior had argued the MCAs might have acted in contempt of a High court order to impeach the governor.

According to Mutula, the move by the Kirinyaga MCAs raises serious fundamental questions of law, and thus, the senators have to await for the proceedings.

“The question whether the County Assembly of Kirinyaga acted in contempt of the High Court order by proceeding to impeach Governor Anne Waiguru raises serious fundamental questions of law . We await the proceedings !” he tweeted.

But responding to senator Mutula Junior, the former Majority leader in the senate argues that the lawmaker might have been whipped by his NASA coalition, and the senator should tell the nation so.

Murkomen argues that it is for either senator Mutual to tore the line, or Raila Odinga-led ODM party takes back their seat.

“Stop shilly-shalling, just tell the nation you have been whipped. You either tore the line or ODM will take their seat,” posted Murkomen.

Governor Waiguru was on Tuesday June 9 impeached after 23 out of 33 MCAs voted to kick her out.

Some MCAs on Monday June 8 spent their night at the Assembly as they prepared to debate an impeachment motion against Governor Waiguru.

The MCAs, who claim to be the majority, trooped to the County Assembly premises on Monday night as they sharpened their tools to tackle the ouster motion against Waiguru.

There was confusion at the Assembly this morning as the pro-Waiguru group insisted that there is a valid court order stopping the impeachment while her opponents insisted that the orders had elapsed as the matter was not prosecuted.

The pro-impeachment MCAs said they have the support of 24 out of 33 members of the county assembly.There was confusion at the assembly as the order paper for the business to be transacted today had not been circulated.

Waiguru has however, vowed to fight on. She claims that the impeachment motion against her was ill-informed and illegal.

She said the issues raised in the motion are baseless and a waste of valuable time that would be better spent handling serious issues impacting the County including Covid-19 pandemic.

She further claimed that she sought and obtained a court order from the High Court stopping any proceedings by the Assembly the impeachment motion until the numerous issues that she had raised with the court are determined.

It is now no secret! Elgeyo Marakwet senator Kipchumba Murkomen has been facing embarrassment in public not less than once.

Just a few weeks ago, we show the majority leader being heckled at Bomas of Kenya in from of President Uhuru Kenyatta and his deputy dr William Ruto as he tried to complain on the way Suna East MP Hon Junet Mohammed was running the BBI report launch program.

On Wednesday 11 December, 2019, chief magistrate Douglas Ogoti did it again as he schooled Murkomen in court during the bail ruling of Nairobi governor Mike Mbuvi Sonko whom Murkomen was representing.

Murkomen indeed had a hard time to explain why he had brought sick Sonko in the court.

And just a day after that embarrassment from Ogoti, Prresident Kenyatta did it himself by condemning those professionals in public service representing private sector, terming it conflict of interest.

The head of state ordered the Attorney General to come up with a bill that will help solve the conflict of interest from public servants.

Just few minutes after presidents order, ODM party Secretary General Edwin Sifuna was at Murkomen’s neck again, blasting him for what he claimed as Murkomen having broken the law profession.

Sifuna’s comment came after a twitter user complained that Siaya Senator James Orengo has been appearing in courts but no issue had been raised. But Sifuna believes that the “level of ignorance of the law displayed by Murkomen and his Makueni counterpart Mutula Kilonzo Jr” that has caused all these problems.

“It is the shocking level of ignorance of the law displayed by those two characters that has caused all these problems. @orengo_james has never brought such anxiety with his appearances. He largely goes to court to teach the law. Murkomen broke the profession,” Sifuna posted.

President Uhuru Kenyatta on Thursday talked tough against professionals in public service in what looked like a direct attack on Elgeyo Marakwet Senator Kipchumb Murkomen and his Makueni counterpart Senator Mutula Kilonzo Junior.

Speaking a day after the duo represented Nairobi Governor Mike Mbuvi Sonko in a graft case, the head of state wants all professionals in public service to forego private practice.

The president during 56th Jamhuri day celebrations at Nyayo stadium ordered Attorney General (AG) Paul Kihara Kariuki to have the Conflict of Interest Bill forwarded to National Assembly in what appears to be a response to Murkomen and Kilonzo Jnr representing Mike Sonko at Milimani Law Courts.

“You either serve the public in the role you signed up for or you serve the republic as a private practitioner. It is a profound conflict of interest to do both,” said President Kenyatta.

Siaya Senator James Orengo has also represented various graft convicts in court, including governors such as Migori’s Okoth Obado.

Rarieda MP Otiende Amollo and Makueni’s Dan Maanzo have also been in courts representing various people in different cases.

Makueni County Senator Mutula Kilonzo Junior has schooled Interior Cabinet Secretary Dr Fred Matiang’i on rescue missions following the West Pokot landslide tragedy.

Matiang’i on Monday failed to land in West Pokot due to what he claimed to be inclement weather.

The Interior CS alongside Devolution CS Eugine Wamalwa and Inspector General of Police Hillary Mutyambai were compelled to land at Eldoret International Airport while on their way to the affected areas..

However, Kenyans were bitter at Matiang’i for failing to land with a military chopper after Deputy President Dr William Ruto managed to land hours later using a private chopper.

Senator Mutula Kilonzo Junior on Tuesday morning while replying to Dr Matiangi’s tweet asked him to watch the videos of the Brazil dam rescue mission early this year.

The senator says choppers were flying near touch down to rescue peole stuck in the mud sludge.

He further notes that the government of Brazil used all means possible to attend to its citizens, urging Kenyan government to learn to be sensitive.

“Please watch the videos of the Brazil dam rescue mission early this year .Choppers were flying near touch down to rescue peole stuck in the mud sludge. The government of Brazil used all means possible to attend to its citizens. GOK must learn to be sensitive ,” he posted.

Areas of Pokot South were over the weekend hit by mudslides which has cost 52 lives leaving several others injured.

Those injured are currently undergoing treatment at Kapenguria County Referral Hospital.
