A vicious property battle between Meru Senator Mithika Linturi and his stepson Arnold Kipkirui takes a new twist to be a all-out family wrangle following the inclusion of the senator’s estranged wife Mary Kitany.

On Monday, the High Court approved the senator’s request to have Ms. Kitany enjoined in the case where her son accuses the legislator of fraud.

The court said that Mr. Linturi’s application was right because Ms Kitany was the CEO of a company, Atticon Limited, which he allegedly used to borrow sh 7 million from Family Bank.

Ms Kitany’s son, Mr Kipkirui, claims that in 2015, the legislator used a title deed for their land in Meru and assets as security for the loan. The property hosts the senator’s office.

Justice Alfred Mabeya said, “I have perused the record, I have not seen her name offered as a witness for any of the parties. It is alleged that she has evidence that can help the court completely adjudicate the case.”

The dispute pits Mr. Kipkirui agianst Mr. Linturi, Atticon Ltd, Brenda Mithika, Emily Nkirote Buantai, Family Bank, the land registrar in Meru, Linkit Limited and the registrar of companies. Other plaintiff include Barons Estate Limied and Noniko Holdings Limited.

The feud originated from the ugly divorce proceedings between Mr. Linturi and Ms. Kitany. Mr. Linturi, Ms. Buantai, Ms. Mithika and Linkit Limited told the court that Ms. Kitany is a crucial party in the case.

As the CEO, she reportedly discovered several unauthorized withdrawals of collosal amounts of money from Atticon’s bank accounts.

The court was told that she reported this to DCI for investigation and recorded a statement to that effect.

This report to the DCI hatched criminal proceedings being contemplated against the senator over alleged fraud and forgery of documents in relation to the loan, securities and changes in the ownership of Atticon Ltd.

Further, the court was told that Ms Kitany was actively involved in one of the companies when the irregularities happened. Also, the same were either sanctioned, overseen or authorized by her.

Ms Kitany and hr son opposed the application, saying she has no personal stake, legal interest or duty in the case s to necessitate her joinder. She declared that she has never been a shareholder nor a director of Atticon Ltd.

But Justice Mabeya said there was prove that Ms Litany was the CEO of the company since she had stated so in another case file at a magistrate’s court. That at her position as the CEO, she found out unauthorized withdrawals f huge amounts of money from the company’s bank accounts which prompted her to report it to DCI for probe.

“Although Ms Kitanyy denied these allegations, a fact stated on oath cannot be denied. When denied, it reflects negatively on a party. It may be that she may may have evidence that can assist the court unravel the dispute,” said the judge.

With her absence in the case, Justice Mabeya said the court may miss an opportunity of having a necessary person with crucial information to assist in determination of the matter.

Kakamega senator Cleophas Malala and his Meru counterpart Mithika Linturi are among the senators who woke up to frozen bank accounts.

Kericho senator Aaron Cheruiyot on Thursday August 13, 2020 had claimed that a number of senators who voted in support of Senator Linturi’s amendment to the revenue formula report had woken up to frozen bank accounts and fictitious tax demands from Kenya Revenue Authority (KRA).

Linturi had moved an amendment to Nairobi counterpart Johnson Sakaja’s proposal on the disputed formula fronted by the House Finance committee which a section of Senators argued that was not favourable to “poor” counties.

He proposed a reduction to the baseline (equal share) from Ksh316.5 billion as proposed by Sakaja to Ksh270 billion.

Malala in an interview with the Star confirmed that indeed his accounts had been frozen but he had chosen to remain silent instead.

“Yes (my accounts have been frozen), but I have decided to remain silent on the matter though I remain firm on my decision to save Kenya,” he was quoted by the local daily.

On Tuesday, the Senate failed for a record eight-time to agree on how the Ksh316 billion from the national government should be distributed in counties.

The senators are set to reconvene today to debate on other proposals fronted by Senators Petronilla Were (nominated), Kimani Wamatangi (Kiambu) and James Orengo (Siaya).

The newly installed Senate majority whip Senator Irungu Kang’ata, has announced new changes in the ruling Jubilee party, as President Uhuru Kenyatta’s purge continues.

The new changes will see Deputy President Dr William Ruto’s allies removed from the leadership of key committees and being replaced by perceived party loyalists.

In the changes, Senator Christopher Lang’at (Bomet)has been replaced at the House Business Committee by Nairobi Senator Johnson Sakaja.

Lang’at also lost his post as Education Committee chairman to Senator Alice Milgo.

Vocal Ruto ally Senator Samson Cherargei (Nandi) was also removed as chairman of the Justice and Legal Affairs Committee.

Meru Senator Linturi Mithika also lost his membership at the powerful Senate County Public Accounts and Investment Committee.

Linturi has been replaced by Senator Fatuma Dullo.

John Kinyua will also lose his position as the chairman of the Devolution Committee in the Tuesday changes.

Former Senate majority leader Kipchumba Murkomen will now be a member of the Devolution Committee.

The changes according to Kang’ata have been communicated to the Senate speaker Ken Lusaka for immediate implementation.

The pastor mother of Marianne Kitany on Tuesday testified to prove to the court that her daughter was married to Meru Senator Mithika Linturi.

Rhoda Chepkoech reminisced about the thoughtful gestures of her ‘son-in-law’ when bought her a car as a gift and contributed Sh1 million for her church fundraiser.

She removed the car keys from her pocket, dangled them and thanked Linturi for giving her the car that she says helped her spread the gospel of Jesus Christ. 

Chepkoech said that the car was outside the court and the court could go to see it, adding that she has been driving it since 2016.

But she also sensationally claimed that the senator took her title deeds that were in Kitany’s custody and used them as collateral for a loan. To date, she has not seen the deeds, though Linturi promised to return them, she testified.

But testifying about happier times, Chepkoech said that Linturi visited her home when the two went through a Nandi traditional wedding ceremony and left there as husband and wife.

For Chepkoech it was difficult testimony, as she said it was taboo to tell a court about things that took place at a traditional wedding. She said, however, that she was convinced she had to shed light on what she called a genuine marriage.

Her daughter Kitany and the senator are in court fighting over matrimonial property. Linturi says he never married Kitany, saying she was just a visitor, while the woman has gone to great lengths to show that the two were an affectionate couple and Linturi was publicly demonstrative. 

Chepkoech kept referring to the senator as Mheshimiwa (Honourable), a title she said she uses because her culture does not allow her to call her son in law by his name.

The mother said the legislator first came to her rural home for a church fundraiser where he contributed Sh1 million in cash. However, she was not aware that he was dating her daughter at that time.

“As a pastor at Africa Gospel church, I thank my son in law who came for a fundraiser before the ceremony in my church,” the court heard.

Chepkoech sent the courtroom into fits of laughter when she thanked Linturi, who was present in court, for donating Sh1 million to her church.

“He came accompanied by several politicians and he contributed Sh1 million cash. I thank you, my son-in-law, for what you did that day,” Kitany’s mother said.

She said that they managed to raise Sh4.2 million that helped the church greatly.

“It was the biggest function and a total of six choppers came for the fundraiser and later the same choppers landed in my home and they had lunch,” Chepkoech said.

Among those present at the fundraiser were Osar Sudi, Kipchumba Murkomen, Governor Ferdinand Waititu, Farouk Kibet, Energy CS Charles Keter and Governor Stephen Sang who was the senator at the time, she said.

It was also her testimony that MP Oscar Sudi knelt before her and asked for her daughter’s hand in marriage on behalf of the senator.

Chepkoech told Chief Magistrate Peter Gesora that Sudi had accompanied Linturi to a fundraiser, then he went to where she was standing and asked that for her daughter’s hand in marriage.

She said that Kitany informed her in 2014 that they were going to Australia to get to know each other with Linturi and their children.

Later in 2016, Kitany told her that they wanted to come home for an introduction and as a mother, she prepared for the function, just as any mum would.

She prepared for Linturi and his people by inviting all her friends and family for the occasion, she said.

Linturi arrived with about 20 people and a pick-up truck full of food, she testified.

She says at the traditional wedding Linturi was asked if he loved her daughter and he told the gathering that he did love her.

Linturi was asked if he was already married and he said he was divorced , she said.

Chepkwony said that as a pastor, she would not have allowed Kitany to marry a married man.

She confirmed that the traditional marriage rites were performed and to her, the two were married according to Nandi tradition.

Chepkoech also told court that Linturi brought a car for her on the same day and presented it to her at the ceremony.

However, the car is still under the name of Linturi’s Atticon company, which has paid the insurance to date.

She said that Kitany left with the Meru people that evening since they were married according to tradition.

Kitany’s mother said  that all the children including Linturi’s children used to visit her during holidays and considered her their grandmother

The court also heard that she had visited Meru several times and interacted with  Linturi Sr, who has since died.

Chepkoech reported the ‘missing’ title deeds matter to the DCI and it’s still under investigation, she said.

The emotional mother told the court that she was saddened at the turn of events in her daughter’s marriage.

Since Kitany was her first-born, she gave her the title deeds to keep, her mother said.

Kitany has strengthened her legal team by adding a Catholic nun to the excitement of the court.

The court heard that Sr Dr Leonida King’ola was among the first nuns in Kenya to practice law in court.

Earlier in the day, Lawyer Danstan Omari accused Linturi’s side of threatening their witnesses at his father’s burial.

He wanted EALA MP Mpuru Amburi to be summoned to explain why he threatened witnesses in the case.

He is alleged to have said at the burial that the witnesses in the case will be cursed by Njuri Ncheke, the Meru Council of Elders.

The case involving Meru senator Mithika Linturi and his estranged wife Merriane Kitany has taken a new twist after Kitany’s mother’s latest confession.

In her confession, Kitany’s mother has dragged in Kapsaret MP Oscar Sudi whom she alleges knelt down before her daughter to propose on behalf of Linturi.

She says Sudi got down on one knee and asked for her daughter’s hand in marriage on behalf of Linturi during a church fundraiser.

“Oscar Sudi even knelt down at the same function and asked for Kitany’s hand in marriage on behalf of Linturi. It was the biggest function. Almost six choppers came for the fundraiser,” she was quoted by a local daily.

on Tuesday narrated how she invited Linturi for a church fundraiser in which he contributed Sh1 million out of the Sh4.2 million raised.

“I thank my son-in-law for coming for a fundraiser before the ceremony in my church,” she said.

Among those present at the fundraiser were Sudi, Elgeyo Marakwet Senaotr Kipchumba Murkomen, Kiambu Governor Ferdinand Waititu, Deputy Preident William Ruto’s aide, Farouk Kibet, Energy CS Charles Keter and Nandi Governor Stephen Sang.

Rhoda said Kitany informed her in 2014 that she, Linturi and their children were going to Australia to get to know each other.

In 2016, Kitany told her mother that she and Linturi wanted to visit her home for an introduction and she prepared for the function.

She said before the wedding, the fundraiser was the first time Linturi went to visit.

During the introduction, Rhoda said Linturi visited accompanied by 19 people and had a pick-up full of food.

Throughout the cross-examination, Rhoda referred to Linturi as ‘mheshimiwa’, saying her culture does not allow her to say the name of her son-in-law.

She said at the traditional wedding, Linturi was asked if he loved her daughter and he told them he did.

Rhoda said Linturi was asked if he was married and he said he was divorced.

Meru Senator Mithika Linturi’s father’s eulogy snubbed former DP William Ruto’s chief of staff, Marianne Kitany, who is in court claiming she is legally married to Senator Linturi.

In Mzee Peter Linturi’s eulogy, Mercy Kaimenyi was listed as his daughter-in-law during the burial that was conducted at his rural home in Igembe South, Meru County in a ceremony that was attended by DP Ruto.

Kitany says she tied the knot with Mithika in a traditional ceremony in April, 2016.

Mithika Linturi, on the other hand, denies that he exchanged wedding vows with Kitany. According to the senator, the mother-of-three only sneaked her way into his life and home as a “visitor”.

In a letter dated January 10, 2019, filed at the High Court Family Division in Nairobi, Linturi said he never divorced his first wife, Mercy Kaimenyi, whom he married in April 2005 at Tigania Catholic Parish in Meru.

Appearing in court early September, Kitany, however, denied being aware of the existence of an active marriage between Mercy and Mithika.

She said she saw the marriage certificate between Linturi and Mercy for the first time in January 2018.

On Monday, September 16, Kitany, through her lawyer, Danstan Omari, said she would attend her “father-in-law’s burial according to the African tradition”.

“The burial of my client’s father in law is tomorrow [Tuesday, September 17] and I do confirm that my client will attend the funeral. We have done all arrangements to attend and give the Late Linturi the respect he deserves as a father-in-law,” Omari told journalists outside the Milimani Law Courts on Monday.

Omari added that he will accompany Kitany to Meru, alongside her relatives from Nandi and Kericho.

“It is the honour and respect of a deceased father-in-law. She has a moral, cultural, legal and philosophical basis to attend the funeral,” said Omari.

However, on Tuesday, neither Kitany nor Omari was spotted at the burial ceremony. It remains unclear why the duo did not attend the function despite Omari’s earlier statement.
