Jubilee party Secretary General Raphael Tuju has spoken on whether National Assembly Majority leader Aden Duale will survive the ongoing purge or not.

Tuju, in an interview with a local daily made an official confirmation that the purge is now headed to the National Assembly, after the senate.

Speaking on Duale’s fate, Tuju said that President Uhuru Kenyatta, who is the Jubilee party boss will have the final say.

Duale is seen to have meticulously pushed through government business in Parliament and moderates in Jubilee have suggested he should be spared.

However, he is also being accused of being among the elite politicians around DP Ruto who have opposed the handshake between the President and ODM leader Raila Odinga.

Also facing the sack are Majority Whip Benjamin Washiali and his deputy, Cecily Mbarire.

The Jubilee National Executive Council is to meet anytime from Friday to set the agenda for the Parliamentary Group meeting tentatively set for Tuesday next week.

“We are on standby. The itinerary of the boss [Uhuru] is very full. But the NEC can even meet on Saturday or Sunday. It all depends on the President’s availability because he chairs the NEC,” Tuju was quoted by the local daily.

About two weeks ago, Elgeyo Marakwet senator Kipchumba Murkomen and his Nakuru counterpart Susan Kihika were removed as the Senate Majority Leader and the Majority Whip, respectively.

With the President’s blessing, Senate Deputy Speaker Kithure Kindiki was impeached in a historic vote that exposed Deputy President William Ruto’s now-shaky grip on Parliament.

Allies of the DP have vowed to even gatecrash the Jubilee Parliamentary Group meeting at State House.

Snubbing a similar meeting two weeks ago turned disastrous for the Ruto brigade after the President marshaled the requisite numbers to kick out Murkomen and Kihika.

In a clear change of strategy, defiant MPs allied to the DP said they are ready to meet face-to-face with Uhuru and make their case.

Details have emerged of how Deputy President William Ruto-owned Weston Hotel colluded with two firms to grab the hotel land in Lang’ata, that is now valued at billions of money.

According to Court documents filed by Kenya Civil Aviation Authority (KCAA), Ruto’s Weston Hotel colluded with Priority Ltd and Monene Investment Ltd to obtain the land.

In a detailed report by the Standard Newspaper, KCAA in its new case filings claim that inconsistencies in the documents produced by Weston, failure to produce any valid sale agreement and transfer instruments, and allegedly ignoring the Ndung’u report’s red flag on grabbed public properties indicated it played a part in grabbing the land.

According to KCAA, there is no consent from the Commissioner of Lands approving the alleged sale, and no stamp duty was paid to seal the purchase process.

“Other questionable circumstances show that the second respondent (Weston) was actually a party to fraud perpetrated by the third and fourth respondent (Priority and Monene) …. This court cannot defer to individual claims by land grabbers where it is proved that the title was issued to grab a public land, in this case, public land entrusted to Directorate of Civil Aviation (DCA) for the public to ensure safety in air navigation and incidental purposes,” the aviation authority argues in its court papers filed in the Lands Court in Nairobi.

KCAA says two development plans submitted by Weston contradict each other. It claims that although the two plans were issued on the same day, October 17, 1997, they are for different plots. It further claims the ownership record is deliberately scrambled to conceal the fraud.

KCAA further notes that Priority was still applying for permit approvals in April 2008, a year after the same land was registered in favour of Weston.

The contested property, LR No 209/14372, was registered under Weston on June 13, 2007.KCAA lawyers Otiende Amolo and Stephen Ligunya argue that Priority could not have continued to deal with the same property after its legal interest in the land ceased.

Weston, in its reply to the case, had attached a payment receipt as proof that it had paid survey fees for the contested piece of land.

However, the civil aviation agency argues that the receipt indicates that the paid amount was for an unsurveyed plot, and is a different property.

According to the authority, its land had been previously surveyed and had a reference number .KCAA questions how Priority and Monene managed to get a survey document (a deed plan) for the contested land more than a year before they paid for the survey, a pointer to fraud.

According to the aviation authority, receipts in Weston’s replying affidavit indicate that it paid for the survey on April 30, 2002, while a deed plan number 234961 in favour of Priority and Monene is dated April 12, 2001.

In a fresh twist to the case, KCAA says Priority and Monene illegally got an allotment for 0.7 hectares of the land, but in their final survey document, the piece mysteriously increased to 0.7733Ha.

Narok senator Ledama Olekina on Tuesday May 26 surrendered his senate Public Accounts Committee chairmanship seat.

This is after the vocal lawmaker met the Orange Democratic Movement (ODM) party leader Raila Odinga this morning.

Ledama also agreed to withdraw the case he had filed against the ODM party following the party’s decision to remove him from the seat, and dewhip him.

Raila, through his official twitter account said that Ledama had agreed to the decisions after they held a meeting. Raila also revealed that the Narok senator had apologized to the party following his decision.

In return, the former Prime Minister said that he had instructed the party to reverse the decision to dewhip the Senator.

“Senator @ledamalekina has this morning agreed to withdraw the case he had filed against @TheODMparty over the Senate Public Accounts Committee chairmanship, surrendered the seat and apologized. In return I’ve instructed the party to reverse the decision to dewhip the Senator,” Raila tweeted.

Early this month, ODM through Minority Leader James Orengo, gave notice to discharge the senator from the County Public Accounts and Investments Committee (CPAIK).

Olekina contested and won the election against his party’s preferred candidate Kisii Senator Sam Ongeri after being backed by Jubilee senators.

He had already chaired the CPAIC’s first meeting when Senate minority leader James Orengo (ODM) gave a notice indicating the party’s wish to dewhip him from the CPAIC and the Senate Business Committee (SBC).

Olekina had vowed to fight the removal, a move that saw him file a case against the Orange party.

President Uhuru Kenyatta has yet again convened another top Jubilee party meeting.

The head of state is set to meet with Jubilee’s key decision-making panel, the National Management Committee.

According to a local daily, President Kenyatta will chair the NMC meeting on Thursday at State House. Members of the parliamentary leadership have been invited.

The meeting is a precursor to a Parliamentary Group Meeting to be held on June 2, when the National Assembly reconvenes from a one-month recess.

This will be the first NMC meeting since President Kenyatta seized control of Jubilee Party from Ruto’s grip after a successful ‘coup’ last month.

Ruto on Thursday last week lost his case before the Political Parties Disputes  Tribunal where he was challenging reconstitution of the NMC.

It is not clear if the DP and his allies would attend the crucial meeting on Thursday to endorse sweeping changes to the National Assembly leadership and approve the President’s working relationship with the opposition.

On Monday Jubilee Party secretary-general Raphael Tuju confirmed the President had called for the meeting, which he termed “critical” to the party’s ongoing housecleaning.

Tuju confirmed the ongoing purge in Parliament targeting members considered disloyal to the President would continue until the Jubilee house is in order.

National Assembly Majority leader Aden Duale, Majority Whip Benjamin Washiali and Senate Majority Whip Irungu Kang’ata, as well as Senate Majority leader  Samuel Poghisio, are among those expected to attend.

NMC members include chairman Nelson Dzuya, Tuju and five newly appointed members.

They are Lucy Macharia, Marete Marangu, Walter Nyambati, Jane Nampaso and James Waweru.

Ruto’s ally Albert Mutai, who is the Jubilee national treasurer, is also a member of the NMC by virtue of his position.

A vocal Deputy President William Ruto allied MP has come out to claim that senators who voted to oust Tharaka Nithi senator Kithure Kindiki as senate deputy speaker, were paid.

According to Bahati MP Kimani Ngunjiri, the senators met at Serena Hotel, where they were given ksh. 100,000 each. He says they were promised to be given the remaining Ksh. 100,000 after their voting.

The vocal Tanga Tanga MP further claims that the entire process in which Prof Kindiki was kicked out was corrupted. He says the senate speaker ignored the voting procedure, where the senators use a special voting system to cast votes, and opted for verbal voting.

According to Ngunjiri, the senators who voted yes rushed quickly after the process, to pick their remaining balance that they had been promised.

He further accused President Uhuru Kenyatta of bringing in their political enemy, the ODM party leader Raila Odinga, to cause troubles in the ruling party. Ngunjiri says that it is President Kenyatta who taught them how to abuse Raila at the time he was fully in opposition.

Kindiki was on Friday last week ousted after a heated debate.

Out of the total 67 senators, 54 voted to kick out the deputy speaker who they accused of party disloyalty and disrespect to the party leader.

At least 26 of senators from the minority side voted in favour of his removal. Only two, Bungoma senator Moses Wetangula and Nominated Judith Pareno did not cast their votes because they were not in the House.

However, Mr Wetangula, who is on a mandatory quarantine after his brother died of Covid19, expressed his support for the removal in a message to Minority leader James Orengo.

Seven senators voted to save Prof Kindiki, a far cry from the tussle of numbers that the pro-Ruto allies have always touted. They were Kipchumba Murkomen, Aaron Cheruiyot, Christopher Langat, Susan Kihika, John Kinyua, Samson Cherargey and Kindiki himself.
