Sirisia Member of Parliament John Waluke and his co-accused Grace Wakhungu are not yet off the hook after Justice John Onyiego of the High Court on September 30 released them on cash bail.

Justice Onyiego granted Waluke and Wakhungu Sh10 million and Sh20 million bail  respectively, pending hearing and determination of their appeal.

The judge also gave them an alternative of depositing bonds of Sh20 million and Sh30 million respectively with sureties.

However, the Director of Public Prosecutions (DPP)  has moved to the Court of Appeal to challenge the release of the two on bond.

The DPP has filed a notice of appeal indicating that he is dissatisfied with the decision made by Justice John Onyiego on September 30.

“Take notice that the DPP, being dissatisfied with the decision of the High Court intends to appeal to the Court of Appeal against the decision in which the court released each of the appellants on bail pending their appeal,” reads the notice.

The notice was also served to the lawyers of the two convicts.

The two, who are also directors of Erad Supplies Ltd, were convicted in June by the Anti-Corruption Court for theft of Sh297 million from the National Cereals and Produce Board (NCPB).

The trial court also imposed a combined fine of Sh2 billion. In default, Wakhungu was handed a 39-year sentence while waluke was slapped with a 34-year sentence.

But they challenged their conviction and sentence and sought to be released on bail pending the determination of appeal.

While allowing their request, Justice Onyiego said he was persuaded that the two convicts have an arguable appeal against the lower court’s judgment.

Makueni Governor Kivutha Kibwana has defended Ruto Deputy President William Ruto’s move to donate goodies to various youth groups, among them being wheelbarrows and handcarts.

Taking to his official twitter account on Wednesday September 30, 2020, the County chief said that the DP is using the opportunity to link up with youths.

“I don’t think Ruto’s main agenda is to dish out wheelbarrows etc. He is trying to bond with youth. You see the Wheel Barrow game? Politics of Symbolism,” Kibwana said.

Recently, governor Kibwana joined Ruto during the installation service of Bishop Rev.Joshua Nzau Kimuyu at the African Inland Church in Ziwani, Nairobi.

The governor has also expressed his interests for the presidential seat come 2022, which Ruto is also eyeing. 

Ruto had earlier defended his action, saying that there is a need to change Kenya’s political conversation from power to empowerment and positions to the creation of jobs.

The DP said that the insults from his critics will not stop him from reaching out to the youths who need his help.

Ruto said that the country can no longer be divided by politicians based on tribes.

Speaking at his Karen residence where he met a section of leaders, Ruto said those poking holes into his work were busybodies.

He said at no point has he failed to serve the country as the principal assistant to the President.

“No work has been given to me and I failed to execute,” he said.

Ruto said all his work and responsibilities given to him by the President have been discharged with distinction.

He also seized the moment to tell those purporting to supervise him to focus on their own duties of service delivery to the mwananchi.

A report by Auditor General Nancy Gathungu has revealed that Kenya Medical Supplies Agency (KEMSA) procurement scandal saw Kenya lose Ksh.2.3 billion.

The report  tabled to the Senate on Wednesday shed light on how KEMSA violated several laws, leading to the staggering losses

The reports notes that for instance, some of the companies that were awarded multimillion tenders had only been around for a few months.

The auditor noted some of the companies that were awarded the contract were established in January and February this year, pointing to possible collusion.

The report also reveals fraud in procurement and collusion between Kemsa bosses and the companies that were awarded multi-billion shilling contracts.

The Senate heard that companies that had been around for less than year were awarded contracts without having the necessary qualifications to supply medical equipment.

According to the auditor, Kemsa over procured items with Sh6.3 billion which are still lying idle in its warehouses.

If the items are sold at the current market prices, Kemsa will only recover Sh4 billion, leading a whopping loss of Sh2.3 billion.

The report shows that Kemsa illegally and irregularly diverted monies meant for UHC to purchase Covid-19 items without approval of the Ministry of Health.

In recommendations to the Senate, the office of the Auditor General calls government agencies to conduct probe to establish criminality in the procurement process and collusion between the management and companies awarded the contracts.

The same report also wants KEMSA to withhold any further processing of COVID-19 related claims until an independent audit is done.

A pastor allied to Deputy President William Ruto is putting up a multi-billion shopping mall in Meru County.

According to Sunday Nation, the Jesus House of Praise Church founder Bishop Kiogora Magambo has kicked off the construction of the Ksh 6 billion million.

The 33-storey project will be among the tallest buildings in the country, and the tallest in Meru County.

The report by the local daily revealed that the mall will be known as Praise Mall.

A Chinese contractor Jiangxi Jingtai Water Conservancy and electric Power Construction Company Limited has been contracted to put up the project within a period of three years.

It is located at Gitimbine, about 100 metres from the iconic Kathita River, along the Meru-Nairobi highway.

The bishop is an influential figure in the Mount Kenya region, especially in church circles, and has been a close friend of Deputy President William Ruto since he was the Eldoret MP.

He is the clergyman who led the final Sunday Service for Dr Ruto on August 28, 2011, before he jetted out to the Netherlands for the confirmation of hearings at The Hague.

He also visited The Hague in October 2013 as the hearings of the cases of crimes against humanity occasioned by the 2007/08 post-election violence against Dr Ruto and radio presenter Joshua Arap Sang were going on. The cases were dismissed in 2016.

Though Dr Ruto has visited Bishop Magambo’s church only once since becoming Deputy President, the clergyman is always present and either plays a role or is at least acknowledged whenever Dr Ruto tours the region.

In an interview with the Sunday nation, Rev Kiogora said he supports both President Uhuru Kenyatta and Dr Ruto and his support was guided by their manifesto, which also convinced him to visit them at The Hague.

President Uhuru Kenyatta has today (Saturday April 25) at State House, Nairobi signed into law the Tax Laws (Amendment) Bill, 2020.

The new tax law amends several statutes to cushion the economy and Kenyans against the effects of the Covid-19 pandemic as announced by the Head of State.

The Amendment Bill, which was published on 30th March 2020, has amended tax-related laws in Kenya including the Income Tax Act (CAP 470), the Value Added Tax Act of 2013, the Excise Duty Act (2015), the Tax Procedures Act (2015), Miscellaneous Levies and Fees Act (2016) and the Retirement Benefits Act(1997).

The amendments include the raise in the threshold for turnover tax to between one million and fifty million shillings so as to exclude small-scale traders from the presumptive tax. The new law further lowers turnover tax rate from 3 to 1 percent.

The amended law, which mainly targets low-income earners, includes a 100 percent Pay As You Earn (PAYE) tax relief for employees earning less than Shs 28,000 per month. Those earning above the new threshold will benefit from a PAYE tax reduction of between 30 and 25 percent.

Similarly, the new Act has revised Corporation Tax to 25 percent while Non-Resident Tax on Dividends has been adjusted from 10 to 15 percent.

The amended law lowers the Value Added Tax rate from 16 to 14 percent, a move that is expected to lower the shelf prices of basic commodities.

The new Act, has amended Section 38 of the Retirement Benefits Act (1997) to allow access of retirement benefits for purposes of purchase of a residential house. This is aimed at increasing home ownership in the country as envisaged in the housing pillar under Big 4 Agenda.

The Bill, which was presented to the President for signature by National Assembly Speaker Justin Muturi was passed by Parliament on Wednesday this week.

Present during the brief signing ceremony were National Assembly Majority Leader Aden Duale, National Treasury Cabinet Secretary Ukur Yatani, Solicitor General Ken Ogeto, State House Chief of Staff Nzioka Waita, National Assembly Clerk Michael Sialai and State House Deputy Chief of Staff Njee Muturi.

Kenya Films and Classification Board (KFCB) CEO Ezekiel Mutua has trashed an official apology issued by gengetone music group Ethic entertainment over their controversial song.

The group was forced to apologize to the public over their song dubbed Soko that contained controversial lyrics .

The moral cop Dr Mutua on Monday condemned the song claiming that it promoted the rape culture and pedophile.

Most fans also agreed with him and supported the ban of the music. The video was recently released and after 3 days it was pulled down from you tube.

The music group had to take to social media to offer an official apology to their fans, as they promised to produce clean content in future.

However, Mutua has not accepted the apology, and has vowed to make sure that the entertainment group faces full force of law.

The moral cop on Tuesday morning took to his twitter account saying that Ethic’s late night statement meant nothing since their controversial song obviously promoted pedophilic culture.

He said they will have to face full force of law as provided for in the Films and Stage Plays Act Cap 222.

“So @ethicofficial issued this statement late last night ostensibly apologizing for their despicable song “Soko” which obviously promoted pedophilic culture. Now listen guys, You will have to face the full force of the law as provided for in the Films and Stage Plays Act Cap 222,” he tweeted.

Naivasha Member of the County Assembly (MCA) Karanja Mburu has passed on after a grisly road accident.

The vocal MCA who is also a close ally to Deputy President William Ruto died in a road accident at Gilgil viewpoint near diatomite.

He succumbed to the injuries he sustained after he hit a tree and his vehicle rolled multiple times.

A number of his supporters have mourned him as a courageous politician and one of the key pointmen for Ruto in Nakuru county.

Malindi Member of Parliament Aisha Jumwa has angrily attacked the police for extorting extorting money from Malindi youth who can’t afford face masks.

Jumwa in a video posted on her social media accounts exposes the police deployed in Malindi for being the most corrupt.

She claims that instead of the police helping out the residents, they are harassing and exposing them to more danger.

According to her, some residents have been duped into wearing their inner wears as face masks just to avoid being arrested.

This, the lawmaker says. puts the residents at more risk of contracting covid-19.

Some, she says, are using just any pieces of clothes, which have been not recommended by World Health Organization.

“Right now, someone can pick underwear or any piece of cloth and wear it, and they will be deemed to be in compliance with the directive simply because they have their noses and mouth covered.

“These substandard masks that people are wearing is putting Kenyans’ lives at risk. I was of the opinion that the government would be issuing masks that meet the World Health Organization (WHO) standards before issuing these directives.

She further claims that the police service is the weakest link in the fight against covid-19 pandemic.

She says the police think they are helping matters but they are only making things worse for the country.

“What is happening here in Malindi is only bringing strife amongst the residents. If there is an organ that is the weak link in the fight against the pandemic it is the police service.

“They think in their minds that they are helping matters but they are only making things worse for the country,” Jumwa stated.

Flamboyant city lawyer Donald Kipkorir has defended himself after cyber bullies landed on him on Thursday morning.

The controversial lawyer took to his social media account to complain about the trolling he has been facing on twitter.

According to him, his social media bullies are from one wing of the ruling Jubilee party.

He says he don’t understand why he is being trolled yet he has no any political ambitions, neither does he hold any public office in Kenya.

The lawyer goes ahead to note that he has nothing to do with the current squabbles being faced in jubilee party, arguing that losers should have themselves to blame.

“Am not in Public Office & have no political ambitions .. I don’t understand why digital terrorists from one wing of Jubilee have to troll me all the time.. I have nothing to do with collapse of Jubilee or destruction of dreams of some people .. Losers should blame themselves,” he tweeted.

Kenyans on twitter on Thursday morning woke up to troll the lawyer under the hashtag #SonkoMalong, a tag he was given by economist David Ndii sometime back when they differed on political opinions.

KOT have been trolling him, with some referring to him as a slayqueen lawyer.

Some, while attacking him, doubted whether his wealth is as a result of his legal practice.

His Thursday morning attack resulted from his comment on one of the local dailies, where he argued that he is never bothered about changes in fuel prices in Kenya, since they don’t affect him.

The National Muslim Covid-19 Response Team has initiated procedures of handling bodies of victims who die of coronavirus, and how their funeral prayers and burial should be conducted.

Chairman of the Response Team, Prof. Muhammad Karama, said the team has also put in place a team of volunteers in Nairobi, Mombasa, Eldoret, Nakuru and Bungoma to handle cases if victims who die from the virus.

“The volunteers with appropriate personal protection equipment will provide assistance in the handling of the deceased cases and ensure that the bodies of Muslims are wrapped in white sheets and placed in a biodegradable sealed body bags before being transported to the burial areas,” said Prof. Karama.

Speaking at a press briefing at the Jamia Mosque in Nairobi, Monday, attended and addressed by Imams, scholars and Muslim medical professionals, he said Muslims who die of COVID-19 will not be subjected to the ritual washing procedures in order to prevent infection and spread of the disease.

“We appeal to Muslims throughout the country to adhere to the government directive to prevent the spread of Covid-19, and to avoid the ritual of washing of bodies of victims confirmed to have died of coronavirus,” said Karama.

“In the event of a death caused by the virus, either at the hospital or at home, a team from the National Muslim Covid-19 Response Committee will be at hand to provide the necessary assistance regarding the handling of the bodies, transportation and burial procedures,” he said.

Karama also called on Muslims to report all home deaths through the toll free number 719 for government assessment before the identified teams engage in the burial procedures.

At the same time, Prof. Karama announced that a team of psychiatrists and psychologists has been put in place to provide counseling and psycho-social support to the families of the deceased.

The Chairman is also coordinating with scholars and Imams in Mombasa while the Supreme Council of Kenya Muslims will play a coordinating role in ensuring that the information is cascaded to the counties.

He said the response team is sensitizing the Muslim community in the country about the coronavirus pandemic, with emphasis on adherence to all precautionary measures put in place by the government in containing and fighting Covid-19.

Karama added that various committees have been put in place to facilitate preparedness and management of the effects of the pandemic, and their role will include body handling, janazah (burial) welfare and resource mobilization, home based care, and psycho-socio support.

The Chairman also urged the government to provide special consideration to Muslims to feed the less fortunate during the forthcoming holy month of Ramadhan which is due in less than two weeks.

Prof. Karama said Muslims have already made arrangements on how the food distribution will be conducted, saying that a team of volunteers will distribute the food directly to the homes of the beneficiaries while adhering to protocols put in place by the Ministry of Health to curb the spread of Covid-19.

The National team thanked doctors, nurses and other medical practitioners who are at the frontline in trying to save the lives of those afflicted with COVID-19.

National Muslim Covid-19 Response Team was formed with the aim of complementing the efforts of the government and the Ministry of Health in addressing the challenges of Covid-19 pandemic in the country.

The Team comprises of Islamic scholars, Imams and representatives from different mosques, Muslim organizations and the Kenya Association of Muslim Medical Professionals.

The public has been warned against waging violent acts on people suspected to be having Covid-19 or those that have travelled from places that have the pandemic.

The warning was sounded by Lamu Governor Fahim Yassin Twaha in light of suspected stigmatisation of Covid-19 cases within the past two months.

He made these remarks earlier today during a press briefing in the county’s Mokowe headquarters over the status update on the county’s preparedness with regards to managing and preventing the spread of Covid-19 within the county.

He revealed that although some two patients had exhibited presumed coronavirus symptoms while being admitted at the Mpeketoni Sub County District Hospital, it was too early to tell whether they were a risk to the community.

“Presumptions have led to rumours of a possible Covid-19 outbreak which is not the case and residents should be careful not to fall under the trap of stigmatising those seeking treatment for similar symptoms, which could just be TB or pneumonia,” Twaha stated.

Flanked by Lamu County Commissioner Macharia Irungu and the Covid-19 Management Committee, the governor further revealed that the samples of the two patients had been taken and dispatched to KEMRI Laboratories with results expected within 24 hours.

“The two patients have already been isolated and contact tracing is already underway to know their travel history,” the governor said.

He advised the public to call the hotline numbers that the county public health had provided to enable trained public health officials handle such suspects instead of people taking the law into their hands.

Twaha also stated that it was very important for people to understand that anyone could get infected and urged residents to adhere to Ministry of Health preventive guidelines.

No Covid-19 case has been reported in Lamu since the outbreak of the global pandemic within the country last month. However, Twaha reiterated that the county government’s health facilities have designated isolation facilities that would help in case of an outbreak in the area.

The governor was optimistic that the measures put in place by the county government were sufficient to tackle the spread of the virus should it arise.

He also commended the Lamu County Assembly for reallocating Sh50 million from their internal budget to aid the county manage the crisis.

The county government has so far set aside Sh10 million as an emergency fund for the county.

“The county is in talks with suppliers to bring in as many ventilators as possible in case of an outbreak, and we will also embark on a massive sanitizer distribution programme to keep the virus at bay.

“We are also organising how relief aid will be distributed to vulnerable families across the county in the wake of reduced revenue streams in more than 60 percent of households within the county,” he added.

He further said that TVETs in Lamu were so far engaged in making as many as 4,000 masks which would be distributed for free across the county as they were now too expensive to buy from any supplier.

These sentiments echoed by CC Irungu who urged well-wishers to coordinate with the Covid-19 county management team to distribute relief items rather than embark on solitary missions.

“We will not entertain individuals distributing relief items outside the designated programme in a bid to win political points. We urge that all relief should be steered towards this committee which will then channel it to the public,” Macharia said.

He also urged members of the public to adhere to the curfew regulations to avoid run-ins with law enforcement agencies whom he said were only keen to ensure the safety of Kenyans within the MOH regulations provided.

Tension gripped Masalani town, Ijara Sub County following the arrival of a man from Covid-19 hotspot, Kilifi County exhibiting symptoms of coronavirus.

The man, who arrived in the area two days ago feverish and with high temperatures, was immediately taken to Masalani Sub County Hospital for isolation.

Contacted for comment, Ijara sub county medical of health Dr. Abdinasir Abdi Mohammed confirmed the patient is in a quarantine unit at Masalani sub county hospital.

He said the suspect’s blood sample was taken to Nairobi for analysis and returned a negative result but he would be under quarantine for 14 days.

Dr Mohamed called on residents to follow government prevention procedures including putting on face masks and keeping social distance.

He cautioned social media bloggers and users against posting sensitive messages with no basis or reference.

He commended Ijara Deputy County Commissioner Mr. Samson Towett and his Covid-19 pandemic committee and disaster preparedness committee for the measures they have put in place towards combating the corona pandemic.

Transport Cabinet Secretary James Macharia has send a chilling message to Public Service Vehicle (PSV) operators who will not adhere to the measures that have been set by the government to stop the spread of coronavirus.

On Sunday evening, Health Ministry’s Chief Administrative Secretary Dr Mercy Mwangangi confirmed 16 more coronavirus cases in Kenya, bringing total number of cases to 142.

Out the cases new cases, 15 are Kenyan citizens and a Nigerian national.

“out of this number 11 have a history of travel while 5 are locally transmitted, ” Dr Mwangangi said.

However, CS Macharia who spoke at a press conference held at Afya House says some matatu operators have been defying government’s directive of carrying less passengers.

He said that defiant matatu operators have been carrying passengers in excess, thus defying the social distance rule.

As from Monday April 6, matatus found defying this rules will have to face the music.

According to CS Macharia, those found violating the regulations will have their operating licences revoked.

The tough talking CS also noted that the people in charge of the respective vehicles will be locked up by the police, and have their vehicles impounded.

Matatu operators are also supposed to have their own sanitizers, and ensure that passengers boarding their vehicles have face masks.

At the moment, all traveling up-country remains banned, with those planning to evacuate their relatives from other countries being required to write to the transport ministry 72 hours prior to planned traveling day.

“We have extended the ban on international flights for 30 more days with effect from April 6. Evacuation and cargo flights are exempted from this ban. However, evacuation flights must give advance 72-hour notice,” CS Macharia said.

Mr. Wandere Maina, a trader who supplies equipment such as tents and chairs to major events like rallies is one of the many traders whose business prospects have been largely affected by the spread of the coronavirus.

It took Wandere 10 years to build his company from scratch to employing over 600 employees. It took the flu virus a few days to bring this number down to 50.

After the first case of Covid 19 was discovered in Kenya, the government directed that all public gatherings and rallies be called off in order to contain spread of the flu virus, leaving Wandere with virtually no one and nowhere to supply equipment to.

From employing over 600 employees he now has only about 50 employees left working for him. Much as the massive lay-offs pain him, there is not much he can do about it.

Another trader, Loise Njeri, who has been running a successful hotel business in Nairobi, finds herself in a similar predicament. Speaking to her, Loise does not sound as excited as she would have sounded some two weeks ago, reason being where as she used to open shop early and close late, now she opens late and closes early thus getting lower returns.

After government discouraged dining in hotels, the number of customers she has been receiving in the past one week has significantly gone down. She is grappling with how to meet rent and taxes at the end of the month amidst heavy losses incurred.

Whereas other eatery businesses have the option of shipping goods to customers based on the orders they have received online, she does not have that option and so has to contend with lower sales. Her business is only accessible to people who pass by her premises while going about their business and her regular customers.

The emergence of the corona virus has similarly taken many other businesses by surprise. Only those with systems such as websites and e-commerce platforms that enable them to carry on with business as usual while maintaining slightest contact with the flu virus are still counting profits as they did before.

As Mr. Felix Mbugua, a tech enthusiast and CEO of web design firm Legibra notes, unfortunate as the abrupt emergence of Covid 19 is, it also comes as an eye opener for businesses to integrate new technologies into the functionality of their businesses so that whenever such an eventually crops up again, they will be prepared.

“The spread of the virus is still relatively under control in Kenya, though even as we remain optimistic that the authorities will be able to effectively contain it, it may be too early to assess the full impact that the virus is going to have on our economy and how long it is going to take us to get back on with our normal lives,” said Mr. Mbugua.

With schools on lock down and companies urging people to work from home, new technologies such as internet of things and artificial intelligence could facilitate students to get an education online, business leaders and manufacturers to run and monitor their businesses all day long with very little reliance on human capital, and customers to purchase goods from retailers without even visiting their shops.

“Businesses that do not have an online presence are going to have a big challenge this time because people are going to be buying goods online,” noted Mr. Mbugua.

Indeed, all over the world, new technologies such as artificial intelligence and the internet of things have significantly boosted economic prospects of digitised businesses.

In America for instance, e-commerce giant amazon is reportedly struggling to hire over 100,000 workers for delivery services to meet the growing demand and shift to digital shopping. The retailer will be targeting people who have lost their jobs following closure of companies they used to work in.

According to Felix however, not all hope is lost because after all necessity is the mother of invention. We could come out of this stronger than we anticipated and find better ways to go about our businesses.

He is encouraging more and more business people to sign up for websites in order to boost their online presence and thus be able to carry on with business as usual while we wait for things to get back to normal.
