Raila Odinga-led Orange Democratic Movement (ODM) party has won big in the just concluded by-elections held in Ganda ward in Malindi and Abakaile Ward in Daadab Constituency.

In the race to determine the MCAs of the respective wards, ODM’s Reuben Mwamure Katana won the Ganda ward race as Mohamed Sheikh won the Abakaile ward seat.

ODM through their official twitter account have congratulated their candidates, urging them to now go and serve the people that elected them.

“Congratulations Reuben Mwamure Katana and Mohamed Sheikh Ali for your victories in Ganda Ward in Malindi Constituency and Abakaile Ward in Daadab Constituency respectively. We are proud of you. Now go and serve your people,” tweeted ODM.

The Malindi by-election recorded a high turn out of voters despite the heavy rains that hit the area.

Hundreds of voters braved the heavy rains and flooded roads to reach polling stations to exercise their democratic right.

Malindi MP Aisha Jumwa ended up being arrested on Wednesday and later freed on bail on Thursday following a fracas when she stormed the home of ODM candidate Reuben Katana in a bid to stop campaigns.

Katana’s uncle was killed in the process.

She said the campaign period was over. 

Jumwa was released on bail on Thursday and declared, “No retreat, no surrender.”

ODM’s Katana defeated Abdulrahman Omar – independent, Joseph Kiponda of Jubilee party and Kadu Asili’s David Mitsanze.

Nairobi Governor Mike Sonko says he will — through his Sonko Rescue Team outfit — transport the bodies of Likoni tragedy victims, Mariam Kighenda and her daughter Amanda Mutheu, from Mombasa to Makueni on Friday.

A representative of Kighenda’s family, Luka Mbaati, on Wednesday told media that the mother-and-daughter’s remains will be transported from Jocham mortuary in Mombasa on Friday night (October 18) ahead of the burial, which will take place at Ngaamba area in Kilome Constituency, Makueni County the following day, Saturday, October 19.

And now, Sonko says he has offered to transport the bodies at no cost to the family.

“We have agreed with those in charge of the burial arrangements to transport the bodies and play any other possible role in the burial arrangements,” Sonko said on Thursday.

The bodies of Kighenda and Mutheu were removed from the sea last Friday, October 11, after staying immersed in the Indian Ocean for 13 days.

Kighenda and Mutheu died after their vehicle, a Toyota Isis, slid off MV Harambee on the Likoni Ferry channel on September 29 and plunged 58 meters into the sea.

Mariam’s family said Wednesday that after burying their loved ones, they will sue the Kenya Ferry Services Limited for negligence.

“We are, currently, continuing with burial plans. Once we have laid our loved ones to rest, we will institute legal action against the Kenya Ferry Services Limited,” Mbaati said.

Thirty five-year-old Mariam Kighenda and her 4-year-old daughter, Amanda Mutheu, suffocated to death, autopsy results released Wednesday, October 16, showed.

According to State’s chief pathologist, Dr. Johansen Oduor, the two died of asphyxia – a condition arising when the body is deprived of oxygen.

Asphyxia, simply known as suffocation, causes unconsciousness or death, Oduor said.

“I can confirm that Kighenda and Mutheu died as a result of lack of oxygen in their bodies. We’ll now hand over the report to police so that they can continue with their investigations,” the pathologist said Wednesday after overseeing the 1-hour and 30 minutes’ postmortem exercise at Jocham Hospital in Mombasa.

Oduor said the autopsy outcome showed that the mother-and-daughter “died around the same time.”

“None of them suffered any physical injury,” said Oduor.

The pathologist, however, said it was impossible for them to ascertain the time Kighenda and Mutheu remained alive under water before finally succumbing.

“We couldn’t establish that because the bodies had stayed immersed in the ocean for long,” said Oduor.

“The longer one remains immersed in water, the more difficult it is to get accurate results on how long one stayed alive before succumbing to asphyxia. Decomposition of the bodies had begun. However, it couldn’t be possible to tell when it exactly started because when one dies in a water body, the [decomposition] process is delayed,” said Oduor.

Likoni lead detective, Charles Onyango, told K24 Digital that they have commenced investigations into the death of the two.

“We are yet to question Kenya Ferry Services managing director, Bakari Gowa, in regard to the mother-and-daughter’s deaths. However, we have lined him up for interrogation,” said Onyango.

Following the Likoni tragedy that claimed the two lives, President Uhuru Kenyatta sacked the Kenya Ferry Services Limited chairperson Dan Mwazo.

In a Wednesday, October 16, Gazette Notice Number 9833, the Head of State said Mwazo was dismissed with immediate effect.

Also fired, were other non-executive board members of the Kenya Ferry Services Limited. They include: Naima Amir, Philip Ndolo, Rosina Mruttu and Daula Omar.

The DCI chief, George Kinoti, has hired city lawyer Donald Kipkorir to represent him in a civil case in which a contempt action against him was filed by Sarah Wairimu-Cohen.

In a letter addressed to Wairimu’s lawyer, Philip Murgor and State prosecutor, Catherine Mwaniki, Kinoti says he “read on social media that Wairimu had sued him for contempt of court”.

Kinoti said he was out of Kenya, and that he has been meant to understand that the State is yet to receive the application of contempt against him.

In the letter to Wairimu’s lawyer, Kinoti is asking Murgor to serve his legal rep, Kipkorir, with the application.

Kinoti has termed the letter as urgent.

On Tuesday, October 15, Tob Cohen’s widow, Sarah Wairimu, filed to have Kinoti, Nation’s special projects boss and senior journalist, John Kamau, and State prosecutor Juma Victor Owiti jailed for six months for contempt of court.

Wairimu’s list also included Office of the DPP (3rd respondent) and that of the DCI (1st respondent). The applicant wants the two offices fined for contempt.

Wairimu said the five respondents disobeyed an edict issued by Lady Justice Jessie Lesiit on September 16, which barred the DCI, DPP and the media from publishing content involving investigations into Tob Cohen’s death.

Wairimu accused DCI chief Kinoti (2nd accused) of “prosecuting” the case against her on September 13 after discovering Cohen’s body in his Kitisuru home.

“…[ On September 13], the 1st and 2nd respondents, knowing well that there was no iota of evidence directly or indirectly linking the applicant to the murder of her husband, continued to prosecute their trumped up case against the applicant through the print and electronic media by going into a frenzy of: malicious and unsubstantiated allegations; unsolicited commentaries; uniformed opinions; and unverified theories, all calculated to depict the applicant as a cold-hearted originator, facilitator and executor of her husband’s initial disappearance and subsequent murder,” said Wairimu in her application filed at the High Court in Nairobi on Tuesday, October 15.

On John Kamau, whom she listed as the 5th respondent, Wairimu accused him of writing a “damning article” published on September 16, which, she said, “cast aspersions on the innocence of the applicant”.

The article, Wairimu said, was titled Inside web of lies that led police to Cohen’s body.

Wairimu also accused Kinoti of holding on to her matrimonial property with the aim of “handing it over on a silver platter to interested parties, including the siblings of the deceased as confirmed in an article published in The Star newspaper on September 16 titled Cohen gave sister Ksh400 million will”.

Juma Victor Owiti, the 4th respondent, is the State prosecutor.

The pre-trial for Tob Cohen murder case begins on October 30.

Nairobi Senator Johnson Sakaja wants appointment of former Othaya MP Mary Wambui to the National Employment Authority (NEA) quashed.

The Senator says the the appointment goes against the provisions of Section 10(2) of the NEA act.

‘I have asked her to politely decline this appointment’, Sakaja said in a statement.

The appointment of Mary Wambui and many other old people brought to sharp focus the issue of youth unemployment since last week.

Sakaja believe that Mary Wambui is no fit for the position and can serve Kenyans ‘in a different capacity’.

‘Hon. Mary Wambui Munene is known to me, as we served together in the 1 1 th Parliament as well as having been a member of The National Alliance party which I chaired. I have confidence that she has the ability to serve Kenyans in a different capacity but not as the vision carrier and Chairperson of the National Employment Authority. I therefore urge her to politely decline this particular appointment’, he wrote.

The Senator went a step further to file a petition to have the appointment revoked.

‘I have further instructed my lawyers as well as those of the Kenya Young Parliamentarians Association to file a petition this morning seeking to quash this appointment. The respondents of this suit are The Cabinet Secretary of Labour, The Hon. Attorney General and Hon. Mary Wambui Munene’, the statement concluded.

COTU Secretary General Francis Atwoli has been relieved his duties as board member of the National Bank of Kenya (NBK) recently acquired by the Kenya Commercial Bank (KCB).

According to a local publisher, KCB has announced the purging of the former board and appointed seven new directors who are expected to breathe a new lease of life into the previously troubled bank.

Atwoli who occupied one of the two seats reserved for the National Social Security Fund (NSSF) nominees represented workers’ interests in the lender.

Besides Atwoli, former NBK Chairman Mohammed Hassan, Mark Obuya and Joseph Kering have also been given the boot.

The new management has also done away with board seats reserved for treasury cabinet secretary and the managing trustee of the NSSF.

“Following the completion of all the regulatory processes for the takeover of National Bank of Kenya, changes have been made to the board of directors,” reads the public notice.

“The directors have voluntarily retired from the board to pave way for the smooth transition,” adds the notice.

In their stead, KCB has appointed  NBK chief executive Paul Russo, John Nyerere, Stanley Kamau, Jones Nzomo, Linnet Mirehane, Gen (Rtd.) Julius Karangi and KCB CEO Joshua Oigara.

“The new board will provide oversight over all the operations of National Bank in line with the overall KCB Group strategy,” adds the notice.

Malindi MP Aisha Jumwa and her bodyguard, Okuto Otieno, have been granted Sh1 million bond and a surety of a similar amount with the alternative of Sh500,000  bail.

“The two shall be released but they must present themselves to DCIO in Malindi on October 22… any further summons shall be issued,” Mombasa Senior Resident Magistrate Vincent Adet said on Thursday.

Adet said that the police shall have the liberty to charge them if they have the evidence.

“It’s illegal for the police to have someone they don’t have evidence against to be held without a charge. Police must only arrest when they have evidence against suspects. The Constitution disallows this,” he said.

Jumwa and her bodyguard, Okuto Otieno, spent the night in the cells as they awaited arraignment on Thursday morning.

The two were held at the court police station.

The prosecution sought to have them detained for 21 days pending investigations.

Jumwa was arrested alongside Otieno, her gardener and domestic worker after one person was shot dead on Tuesday.

The man was shot dead during a fracas that erupted at the home of ODM candidate Reuben Katana in Ganda ward.

Trouble started after Jumwa stormed the home to disrupt the meeting between Katana and ODM agents for the Thursday’s by elections, saying the campaign period was over.

The weatherman has warned that Nairobi, Central Kenya and Coastal counties will experience heavy rainfall of more than 20mm beginning Wednesday, October 16, at 6am.

Besides the listed areas, the intensity of the rainfall is expected to hit at least 40mm in Western Kenya, North Eastern and South Eastern regions beginning Thursday, October 17, to Sunday, October 20 at 9pm.

Mombasa, Kwale, Kilifi, Tana River, Lamu, Nairobi, Nyeri, Kiambu, Nyandarua, Murang’a, Embu, Meru, Kirinyaga, Tharaka-Nithi, Kitui, Machakos, Makueni, Taita-Taveta, Busia, Kisii, Nyamira, Kericho, Bomet, Nakuru, Narok, Migori, Nandi, Trans-Nzoia, Uasin-Gishu, Elgeyo-Marakwet, Vihiga, Bungoma, Homa-Bay, Kisumu, Siaya, Kakamega, Kajiado, Nakuru, Marsabit, Mandera and Wajir are the counties that the Kenya Meteorological Department says will be hardest hit by the downpour.

“Residents in all the mentioned areas are advised to be on the lookout for potential floods,” said the Kenya-MET in a press statement to newsrooms.

“Flood waters may suddenly appear even in places where it has not rained heavily and can be deeper and faster than they look, especially in semi-arid and urban areas,” added the weatherman.

“Residents are advised to avoid driving through, or walking in moving water or open fields, and not to shelter under trees and near grilled windows to avoid exposure to lighting strikes,” said Kenya-MET.

The weather forecaster has advised Kenyans living in landslide-prone areas such as Mt Kenya and Central Kenya regions “to be on high alert”.

“The heavy rains and moderate to strong winds may result in storm surges along the Coast, hence fishermen and all the marine industry should be on high alert,” said the weatherman.

Malindi MP Aisha Jumwa spent the night in police custody over the violence that broke out at Ganda ward in Malindi on Tuesday evening.

A man was shot in the shoulder and killed during the chaos and several other people, including police officers, were injured. Jumwa had stormed a meeting organised by Reuben Katana, an ODM candidate in Thursday’s by-election.

Gumbao Jola, 48, died upon arrival at Malindi General Hospital. He was Katana’s uncle.

The MP arrived at the meeting in a convoy of three vehicles. Thereafter, chaos erupted and police officers were forced to shoot in the air several times. The lawmaker is the chief campaigner for independent candidate Abdulrahman Omar, according to her lawyer Jared Magolo.

The MP, whom the police described as confrontational and fond of making inciteful statements in public, accused Katana of campaigning long after the campaign window period had been closed.

Katana was hosting more than 500 people at his home. Jumwa and her bodyguard, Geoffrey Otieno, are suspects in Jola’s murder.

The two were arrested on Wednesday at 1.50am, taken to Port police station in Mombasa before they were arraigned at 2.30pm, her lawyer said. Initially, there were reports that four people had been arrested, but only two were arraigned.

Jumwa and her bodyguard were, however, not charged as assistant Director of Public Prosecutions Alloys Kemo applied to have them detained for 21 more days, pending investigations.

In a sworn affidavit, Kemo said the police want to hold the MP and her bodyguard as they investigate four charges — murder, incitement to violence, breach of Election Offences Act and breach of electoral code of conduct.

“Police have intelligence that the first respondent’s (Jumwa’s) agents are planning to disrupt the Ganda by-election tomorrow. They are regrouping at Takaungu,” Kemo said.

He added that security agents at the coast cannot guarantee the security of Jumwa and her bodyguard because the Malindi residents are baying for their blood.

“A large crowd gathered at Malindi police station on Tuesday night chanting that they want to avenge the death of Gumbao Jola. The two should be detained because the situation in Malindi is tense and volatile,” Kemo said.

He added the police need enough time to conduct an autopsy on the body and carry out a ballistic investigation on the firearm used to kill Jola.

“Police also need to find out if the second respondent (Jumwa’s body guard) is a licensed gun holder. A ballistic investigation will be conducted on the gun and the bullet cartridges that were recovered today at 2am,” he said.

However, Jumwa’s lawyer Magolo described the DPP’s application as “hopeless.”

“The application is actually crying for dismissal.  This court should not agree to be allowed to take sides in an election contest.

“We know there are people who want to take away Jumwa from Malindi because she is the chief agent of a candidate in Ganda’s by-election,” Magolo said, adding the DPP is dishonest in his submission.

“They have admitted that was an illegal gathering. It was taking place after the official closure of campaign period. Jumwa is an MP and a chief agent of a candidate in that election and had gone to seek answers, but she was then attacked,” Magolo said.

Jumwa is represented by four lawyers in the case. Her second lawyer, Gikandi Ngubuini said the are no records to show that Jumwa is confrontational.

“No records have been produced to show the first respondent has ever been found guilty of incitement. No evidence has been filed in this court from any person to show that once the MP is released there would be violence in Ganda,” Ngubuini said.

On Wednesday evening, Mombasa senior resident magistrate Vincent Andet said he would make a ruling on whether to release Jumwa on bail or continue holding her as requested by the DPP today.

“It’s already late in the evening and I’ve not been able to go through all the submissions. I would request that I deliver a ruling tomorrow (Thursday) at 8.30am,” Andet said.

According to Jumwa, the meeting was aimed at planning violence against her supporters with a view to ensure her candidate loses.

`The embattled legislator has been branded a rebel and ousted out of Raila Odinga’s party for supporting Deputy President William Ruto’s 2022 presidential bid.

Attempts by Ida Odinga, through her lawyer, to stop the media from publishing details about the Fidel Odinga property row pitting his widow, Lwam Bekele, against Ida and her daughter, Winnie, have been thwarted by High Court judge Aggrey Muchelule.

Ida’s lawyer, Victor Olao, sought orders from Muchelule on Wednesday to have the media stopped from covering the dispute that has ended up in the public space.

“You are fighting in an open court; therefore, we cannot stop the media [from accessing the courtroom, or covering the case]. If the media finds the story juicy, let them publish [its details],” Muchelule told Olao.

Muchelule, earlier Wednesday, ordered a DNA test on twins allegedly sired by the late Fidel Odinga.

The judge directed that the test be conducted to ascertain the paternity of the two before proceeding with the succession case.

This is after Lwam objected to an application filed by Ida Odinga and her daughter, Winnie, seeking for grant of representative in the estate.

In her response, Lwam asserted that her son is the only heir to her late husband’s properties, denying knowledge of the said twins whose interest was raised by Ida and Winnie.

Lwam said Ida and Winnie’s application to have her son co-share the properties with the twins has been overtaken by events, having been allegedly filed outside timelines stipulated by the law of succession.

She said the grant of letters of administration of the estate was already issued on January 9, 2019.

Lwam claims that birth certificates of the twins, which were attached in Ida and Winnie’s affidavits, did not indicate the father of the minors, hence it is yet to be proven that Fidel sired the children.

She further claims the birth certificates show the minors were born on July 1, 2015, six months after Fidel’s death but Ida and Winnie alleged Fidel was already supporting the children.

But Lwam said that if it’s proven that her late husband fathered the minors, she will include them as beneficiaries.

The widow also denied claims that she has hidden her son from Raila’s family or even withdrawn him from the formal education system as alleged by her mother-in-law.

Malindi MP Aisha Jumwa is being detained at the Kilindini Police Station in Mombasa following her arrest on Tuesday night after an Orange Democratic Movement supporter was shot dead.

The chaos which led to the fatal shooting of the ODM supporter broke out after the legislator stormed a meeting organized by the party officials at the home of its candidate for Thursday’s Ganda Ward by-election.

Jumwa was arrested at her home in Kakuyuni and taken to the Malindi Police Station before being moved to Mombasa.

Reports indicated that violence erupted moments after Jumwa stormed the meeting at Pendukiani village in Ganda at about 5pm demanding that the meeting be stopped because election campaigns officially ended on Monday.

It is alleged that Jumwa and her supporters confronted the ODM leaders who were at the time meeting with over 300 supporters under tents.

Those present included Mombasa Deputy Govenor William Kingi, Magarini MP Michael Kingi, Kilifi North MP Owen Baya, former Malindi MP Willy Mtengo and several ODM officials from Nairobi and Mombasa.

During the fracas, Ngumbao Jola was reportedly shot on the chest and was pronounced dead on arrival at the Malindi Sub County Hospital.

Tension is high in Malindi and the entire Ganda ward following the death as ODM leaders claim Jumwa is responsible for the shooting.

They claimed the meeting was meant to recruit agents and not a rally as alleged by Jumwa.

Vincent Safari Katana, a relative of the deceased, was at the meeting and said everything was well until Jumwa arrived with her supporters.

He said the incident occurred at about 5 pm when they were planning how agents would be deployed to different polling stations.

”I saw Aisha Jumwa and goons, they started chaos and disrupted the meeting. At that time, there were about eight police officers who were trying to keep peace,” he said.

He said Jumwa was hostile and wanted to fight other people, including women leaders who were present.

Hamisi Musa, another ODM supporter who was at the meeting, said they were not in a rally and no MP or leader present addressed political matters.

He wondered why the MP had stormed the meeting, leading to the death of one of their own.

The deceased is said to be a relative of Katana.

At the Malindi Police station, ODM leaders who had camped there to record statements, accusing the police of failing to act against the MP.

Magarini MP, who was leading the delegation, said Jumwa should be held responsible for the death.

Kingi said he was also assaulted while defending two supporters who were being sought by Jumwa supporters.

However, in a quick rejoinder, Jumwa dismissed claims that she shot the ODM supporter during the fracas.

Jumwa said she spent the better part of Tuesday in Watamu and while taking lunch at Crab Shack Restaurant, her supporters who were in the meeting, sent pictures informing her of the ongoing rally.

The MP, who spoke at her home, said she called the OCPD Malindi to inform him about the meeting but they took no action.

”By evening when the police failed to act, I called the OCPD again and told him I would take action because campaign period is over and that’s why I stormed the meeting,” she said.

During the chaos, Jumwa said police officers asked her to leave as they would handle the situation and by the time she left no one had been shot.

She asked investigating agencies to conduct investigations to establish who pulled the trigger.

A newly-elected Tunisian MP has appeared in court over a video allegedly showing him masturbating in front of a school.

Zouheir Makhlouf, a member of the Qalb Tounes party whose leader lost the presidential contest on Sunday, represents the coastal town of Nabeul.

The MP said he was diabetic and he was urinating into a bottle in the video.

The video which was widely shared across social media prompted women to share testimonies of sexual harassment under the hashtag Ena-Zeda, meaning Me Too in the Tunisian dialect.

Current and former governors could soon find themselves on the radar of detectives after a parliamentary committee recommended graft investigations of their administrations.

The Senate Public Accounts and Investments Committee wants at least 10 governors and seven former county chiefs investigated for the possible loss of funds during their tenures.

Some of the counties mentioned in the PIAC 2014-15 report include Nyamira, headed by John Nyagarama, Kivutha Kibwana’s Makueni, Paul Chepkwony’s Kericho, Uasin Gishu, led by Jackson Mandago, Salim Mvurya’s Kwale, Embu headed by Governor Martin Wambora and Kilifi under Amason Kingi.

Former governors whose administrations were put under the microscope include Benjamin Cheboi (Baringo), Issa Timamy (Lamu), Joseph Nduati (Kirinyaga), Kinuthia Mbugua (Nakuru) and Peter Munya (Meru).

The watchdog panel scrutinises the county governments’ books of accounts. It has recommended the Ethics and Anti-corruption Commission and the Directorate of Criminal Investigations close in on possible culprits.

The committee reports that some governors have been overseeing massive irregularities, ranging from flawed multimillion-shilling tendering processes, blatant conflict of interest, overpayments and misuse of car loans and mortgages.

It says some counties have been diverting public funds to items not budgeted for, funding ghost projects and inflating costs.

The report notes that some counties are still spending locally generated revenue at source, an avenue that has been identified as a major outlet for siphoning public funds.

In the report, a copy of which the Star has obtained,  the Moses Kajwang’-led committee says Nyagarama’s administration has trampled on procurement rules.

The committee notes that the county government has a poor bookkeeping regime and huge capacity challenges in the accounting and procurement departments.

For instance, it says, most of the staff working in the department are not registered with the relevant professional agencies, raising concerns about their capacity to handle tasks.

There were no proper records for workers’ loans and mortgages, casting doubt on the sustainability of the multimillion-shilling scheme meant to provide cheap facilities to workers.

The committee wants the EACC and DCI to investigate Sh60 million spent by the county in the purchase of three heavy earth-moving equipment without a valid contract with the supplier.

The county government did not enter into its own agreement with the supplier but instead relied on the terms of the deal the contractor had with the Ministry of Transport and Infrastructure, the committee says.

It also wants Nyamira procurement and accounts officers probed for failing to provide supporting documents for the expenditure of goods and services amounting to Sh4.8 million.

“The committee recommends that the responsible officers be prosecuted for breach of Section 62 of the Public Audit Act,” says the PIAC.

The committee also cites the county for single sourcing casuals for various civil works amounting to Sh7 million and procuring resource mapping services at a cost of Sh21.7 million through direct procurement.

The team wants Governor Mandago’s administration investigated for a Sh378.9 million loan advanced by the Kenya Commercial Bank.

It wants the EACC and DCI to establish why the county paid the money from the loan directly into the machinery suppliers’ accounts without first banking it at the County Revenue Fund as required.

“The committee noted that there was a material breach of procedures and law, recommends further investigation on whether there was adherence to procurement process,” say a Report.

The panel learnt that the statement of receipts and payments reflected nil proceeds from domestic borrowing yet the county had taken a loan from KCB.

The committee wants the EACC and DCI to establish why only Sh378.9 million was received by the county yet the devolved unit had signed a loan agreement for Sh484.4 million with KCB.

The procurement of computers, printers and digital cameras for Sh9. 9 million in Makueni should be investigated as well, the team recommends.

Governor Kibwana’s administration did not convince the panel why the orders were split into a number of smaller quantities, contrary to Section 30 of the Public Procurement and Disposal Act, 2005.

The law requires procurement exceeding Sh6 million to be done through open tendering.

“The committee noted that the non-compliance of the law resulted in the loss of public funds and recommends that the DCI and EACC should investigate the violation of the process and law with the view to prosecute those responsible,” reads the report.

In Kwale county, the administration invested more than Sh93 million in the purchase of tree seedlings, some of which disappeared into thin air, according to the panel.

The committee concurred with the Auditor General’s report that up to Sh8.7 million spent by the Department of Lands, Physical Planning and Natural Resources to buy 200,000 tree seedlings could not be accounted for.

It notes auditors visited various ward administration offices but could not physically verify where the seedlings were planted.

“Therefore the committee recommends that the DCI and EACC should investigate the responsible officers with a view of the recovery of the funds and prosecution for breach of the Public Procurement and Disposal Act,” the committee says.

It wants Governor Wambora’s government investigated for funding stalled projects. This follows the county’s decision to pay contractors substantial amounts of money before works are completed.

Some of the works include water projects valued at Sh79.9 million. “Where money has been paid for incomplete work, the contractor and responsible officers should be investigated and prosecuted with a view of the recovery of the funds lost,” the committee says.ADVERTISING

In Kilifi, the team points out, Sh23.4 million was paid to the personal bank accounts of three individuals during the year under review.

The Kingi administration told the committee that the payments related to allowances paid to MCAs for meetings and activities initiated by the executive.

The county said the payments were wired through the personal accounts of three county officers to cater for subsistence allowances for MCAs as the county assembly had exhausted its allocation for members’ allowances.

But the committee recommends the officers be prosecuted for breach of Section 62 of the Public Audit Act, saying they failed to provide documents.

The team also points out that at least eight suppliers were contracted for Sh5.8 million yet they were not on the pre-qualified list for accommodation and catering services.

Former Meru Governor Munya’s administration is on the spot for irregular renewal of an insurance scheme for county workers without open tendering after the expiry of the contract.

The county had contracted an insurance firm to offer enhanced medical cover at a sum of Sh31.6 million but renewed it at Sh139.9 million after the deal expired.

The increase of Sh108.2 million reflected a 342 per cent increase and was above the 25 per cent variation allowed under the law, the committee says.

“The accounting officer who caused Meru county to suffer financial loss through the insurance cover be held liable and further investigations on the matter should be carried out by relevant bodies on how Gold Field became a broker,” the committee states.

It also wants Machakos Governor Alfred Mutua and former county chiefs Cleophas Lagat (Nandi) and Samuel Ragwa (Tharaka Nithi) investigated. And Siaya Governor Cornel Rasanga and former Nairobi Governor Evans Kidero surcharged.

Tob Cohen’s widow, Sarah Wairimu, now wants DCI chief, George Kinoti, Nation’s special projects boss and senior journalist, John Kamau, and The Star reporter Juma Victor Owiti jailed for six months for contempt of court.

Wairimu’s list also includes Office of the DPP (3rd respondent) and that of the DCI (1st respondent). The applicant wants the two offices fined for contempt.

Wairimu says the five respondents disobeyed an edict issued by Lady Justice Jessie Lesiit on September 16, which barred the DCI, DPP and the media from publishing content involving investigations into Tob Cohen’s death.

Wairimu accused DCI chief Kinoti (2nd accused) of “prosecuting” the case against her on September 13 after discovering Cohen’s body in his Kitisuru home.

“…[ On September 13], the 1st and 2nd respondents, knowing well that there was no iota of evidence directly or indirectly linking the applicant to the murder of her husband, continued to prosecute their trumped up case against the applicant through the print and electronic media by going into a frenzy of: malicious and unsubstantiated allegations; unsolicited commentaries; uniformed opinions; and unverified theories, all calculated to depict the applicant as a cold-hearted originator, facilitator and executor of her husband’s initial disappearance and subsequent murder,” said Wairimu in her application filed at the High Court in Nairobi on Tuesday, October 15.

On John Kamau, whom she has listed as the 5th respondent, Wairimu accuses him of writing a “damning article” published on September 16, which, she says, “cast aspersions on the innocence of the applicant”.

The article, Wairimu says, was titled Inside web of lies that led police to Cohen’s body.

Wairimu also accuses Kinoti of holding on to her matrimonial property with the aim of “handing it over on a silver platter to interested parties, including the siblings of the deceased as confirmed in an article published in The Star newspaper on September 16 titled Cohen gave sister Ksh400 million will”.

The story had the name of Juma Victor Owiti, the 4th respondent, as the author.

Meanwhile, the pre-trial for Tob Cohen murder case begins on October 30.
